No \u00e9s un tr\u00e0mit obligatori, per\u00f2 \u00e9s molt habitual, independentment de si \u00e9s entre particulars o de si el venedor \u00e9s un promotor. Normalment s&#8217;acompanya d&#8217;una paga i senyal. Encara que \u00e9s un contracte privat sempre ha d&#8217;haver-hi una validesa jur\u00eddica i, per tant, les dues parts estan obligades a complir-lo.<\/p>\n<p style=\"text-align: justify;\">Abans de signar \u00e9s important tenir en compte que si \u00e9s una <strong>venda de pisos<\/strong> entre particulars has de cerciorar-te que tots els propietaris de l&#8217;immoble han signat, per a evitar problemes a posteriori. Una vegada signat, assegura&#8217;t d&#8217;haver demanat els seg\u00fcents documents; c\u00e8dula d&#8217;habitabilitat, certificat energ\u00e8tic, DNI, nota simple, IBI pagat i assegura&#8217;t que no hi ha deutes pendents.<\/p>\n<p style=\"text-align: justify;\">I els tr\u00e0mits de compra d&#8217;un habitatge, \u00e9s a dir, el proc\u00e9s de compra venda es basen en:<\/p>\n<p style=\"text-align: justify;\">Contracte d&#8217;arres; consisteix en un contracte amb el qual el comprador lliurament al venedor una quantitat de diners en forma de paga i senyal, que es descomptar\u00e0 del preu total de l&#8217;habitatge. La quantitat sol rondar un 10% del valor total de l&#8217;immoble.<\/p>\n<p style=\"text-align: justify;\">Les arres m\u00e9s comunes s\u00f3n les penitencials, les quals determinen el preu que cal pagar per cada part en cas que s&#8217;anul\u00b7li l&#8217;operaci\u00f3 de compra venda de l&#8217;habitatge, en la qual el comprador perdria l&#8217;import acordat i el venedor, per part seva, hauria d&#8217;abonar el doble del pagat si \u00e9s ell qui cancel\u00b7la la venda de pisos.<\/p>\n<p style=\"text-align: justify;\">Quant al notari, deixa const\u00e0ncia del canvi de propietari del pis i de totes les noves condicions de venda, mitjan\u00e7ant l&#8217;elevaci\u00f3 del contracte a escriptura p\u00fablica.<\/p>\n<p style=\"text-align: justify;\">Despr\u00e9s d&#8217;aquest pas haur\u00e0s de pagar l&#8217;impost de transmissions patrimonials (ITP) durant els 30 dies posteriors a la venda i la quantia dependr\u00e0 de cada comunitat aut\u00f2noma, encara que se situa entre el 4 i el 10%.<\/p>\n<p style=\"text-align: justify;\">El comprador \u00e9s qui es far\u00e0 c\u00e0rrec de les despeses notarials.
